Uncle Giuseppe’s Marketplace weighs in on the operational and financial realities facing independent grocers under evolving refrigeration regulations.

At the ATMOsphere America Summit, industry leaders, policymakers, and grocery operators convened to address evolving refrigeration regulations, with a strong focus on the challenges facing independent grocers in New York.

A key highlight was the Independent Retailer Panel, where Michael Nelson, President of Uncle Giuseppe’s Marketplace, shared insights into the operational and financial pressures created by Part 494. The regulation mandates a transition to natural refrigerants—an investment that has disproportionately impacted smaller operators, even as New York’s standards continue to exceed federal requirements.

Throughout the summit, discussions underscored the essential role independent grocers play in their communities and the urgent need to close the CO₂ compliance funding gap. Attendees engaged directly with state, city, and federal stakeholders, advocating for more equitable funding structures.

Panelists, including Anthony Peña of the National Supermarket Association and Edwin Gutierrez of Aurora Grocery Group, reinforced the importance of targeted support to ensure independent retailers can meet compliance requirements while remaining viable in a rapidly changing regulatory landscape.
